1. Our Position on Copyright

BongoFleva respects the rights of songwriters, performers, producers and rights holders. We remove infringing material promptly when we are notified of it, and we terminate the accounts of users who repeatedly infringe.

If you believe material on BongoFleva infringes a copyright you own or control, you can send us a notice using the process below. You do not need a lawyer to do this, and there is no cost.

2. Designated Agent for Notices

Send all copyright notices to our designated agent:

3. How to File a Notice

To be effective, your notice must include all of the following:

• Your physical or electronic signature.
• Identification of the copyrighted work you say has been infringed. If several works are covered by one notice, a representative list of them.
• The exact URL of each track or page you are reporting, in the form https://bongofleva.com/go/…, so we can locate the material.
• Your name, postal address, telephone number and email address.
• A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on the owner's behalf.

Incomplete notices slow things down. If yours is missing something we will tell you what is needed rather than ignore it.

4. What We Do When We Receive a Notice

• We acknowledge valid notices within 2 business days.
• We remove or disable access to the reported material, ordinarily within 5 business days of a valid notice.
• We notify the user who uploaded the material and give them a copy of the notice.
• We record the notice against that account for the purposes of our repeat-infringer policy.

5. Counter-Notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to [email protected] containing:

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the courts of Dar es Salaam, Tanzania, and — where applicable — the federal district court for the district in which your address is located.

If we receive a valid counter-notice we will forward it to the party who filed the original notice. We may restore the material after 10 business days unless that party notifies us that they have filed an action seeking a court order.

6. Repeat Infringers

We terminate, in appropriate circumstances, the accounts of users who are the subject of repeated valid copyright notices. Three valid notices against one account will ordinarily result in termination and removal of that account's catalogue.

7. Misuse of This Process

Knowingly making a material misrepresentation that content is infringing — or that it was removed by mistake — can carry legal liability for damages and costs. Please only report material you genuinely hold rights in.

8. Artists and Rights Holders in Tanzania

If you are a Tanzanian artist, producer or rights holder and would prefer to resolve a claim directly rather than through a formal notice, write to [email protected] and tell us which tracks are yours. We will take them down, correct the credit, or set up an artist account for you — whichever you prefer.

Nothing in this policy limits any rights you have under the Copyright and Neighbouring Rights Act of the United Republic of Tanzania, or your rights through a collective management organisation.
